Clare picked up an £85 parking ticket for parking in this pub car park between 21h and 22.30h on a Friday evening.

What are the chances of getting the ticket cancelled on the basis that the placement directly behind a council sign indicating 8am to 6.30pm parking restrictions is misleading without a clear 24h restriction notice?
 
Definitely worth a shot.

What on earth does "Customer refunds available" mean?
 
I'd call whoever issued the ticket and explain. It doesn't look clear cut and I can't imagine they insist you pay when they see that photograph. (Assuming there are no other signs around)
 
If she went to the pub and paid, why did they issue a ticket? The sign doesn't seem to be clear.

The small print under the entrance sign directs you to additional signage “on site”.

Will they refund the fine?! Sorry...

I'm assuming that a ticket is always required, a fine should only be given if no ticket displayed / out of time OR you're parked between 08:00-18:30 Mon to Fri...

Sorry - I should have been clearer. Clare parked in the car park, assuming the charges applied 8am to 6.30pm as the road parking restrictions. She was a customer in the pub but had not bought a parking ticket.

Had she bought a ticket she could have had the cost of the ticket refunded.

It was an honest mistake.
 
I assume the yellow sign has nothing to do with the carpark but relates to the adjacent highway ?

What does it say on the white sign under “customer refunds available”?

I would contest this as it’s very confusing. To be fair to people parking they should make it clear that you MUST buy a ticket.

Go for it, Amarillo, they’re out of order!

The 8am to 6.30pm restriction is for parking on the street. The car park charges apply 24 hours per day 7 days per week. The car park charges are refunded to pub customers.

Clare was a pub customer but didn’t buy a parking ticket as she didn’t realise the car park charges were 24/7 because of the sign’s placement behind the street parking restriction sign.

It is confusing - I would contest it, state your reasons, nothing to loose.
 
Hi Tom, worth a try on grounds of conflicting/ambiguous information. If anyone can get it cancelled you can. :thumb
 
These Private Parking companies are turning into a bunch of horrible little Nazis...
Our town has a few of these around now. But they are ticketless and you are required to enter the premises and buy something which you will be given a receipt and that then is entered into a terminal with your reg.
Thankfully I walk or cycle most places. But the vast array of them and their different rules etc depending on company is very confusing...

I feel it’s not a fair playing field at the moment and they should all adopt one system.
I.e.
Buy a ticket and display...

Motorists are seen as cash cows and a soft touch...

I think local councils listen and are sympathetic if there's grounds for dispute but private firms are a different story... it's their income from honest mistakes like this that they will uphold... do they have the same legal clout or do they have to pursue fines through the court system if contested?
 
There is a pub we use at lunchtime with a similar set up.
Inside the pub on the bar is a screen where you type in your reg no. Job done.
No number typed in then expect a fine.
 
I think you’d be lucky to get a refund based on the signage. The yellow “official” sign together with a yellow line on the road would be used on the public highway and relate to the highway. The blue one clearly states it relates to private land. Worth a try, good luck!
 
Is the car park ticketing run for the pub? If so, can you prove (eg, till receipt with time) that you were a customer and get them to quash the fine?
