I paid for the All-in warranty only to discover 7 months later that my van still had an extended warranty from new, taking it from 3 to 4 years. I have contacted VCVFS and questioned this and I asked for the warranty element of the All-in to run from the expiry of the 4 year warranty. They have flatly refused to do this and said that ‘as a matter of goodwill’ they will close the whole plan down and refund me £443.54 as I have already used up £444.46 worth of MOT and Oil service.

I feel quite put out and angry about this as I paid £888 for the All-in plan because VW and the dealer advised me that I could not take out the All-in plan until my existing warranty expired and I wanted to maintain cover. I believe that I was mislead and (probably) mis-sold a plan that was not really necessary as that time.

All I have asked for from VCVFS is to put back the start date of the ‘warranty element’ of the plan so that it will give me 2 year’s warranty extension when the current one expires. I am not asking for a refund and for the record I certainly would not have used the main dealer for the MOT and Oil service that I have had at a cost of £444.46. I can’t help but think that VCVFS are holding me to ransom over this (to be polite!) and that my claim is not unreasonable. I am simply asking to be supplied with what I have paid for.

Has anyone else experienced this? What would you do?

I think this would be viewed favourably in the Small Claims Court.

So you received 1 servic, 1 MOT, 1 yrs VW Assistance and 1 yrs warranty that overlapped with the 4 th year warranty that came with the van.
VW Assistance is only fr 3 yrs on a new vehicle , you have to pay thereafter at £120/ yr.

So all you’ve lost is 1 yrs warranty.

Personally I would accept the £443.54 reimbursement and take out a new All in One plan when the present one expires.

All you have actually lost is the ? cost of 1 yrs warranty.

The £444.46 represents £120 for VW Assistance and £324.46 for MOT and Service At a Dealership which is a requirement of the Plan.

I agree with @WelshGas. They have offered you 50% of the cost back, and it’s really not worth the bother of arguing further in my opinion. Depending on how close you are to 4 years, I would be inclined to let the policy run for a low stress life!
Actually, having re-read I can see you are only 7 months in, so maybe take the refund.

I had something very similar when I bought my Cali. I signed up for the All in one policy after been offered it from the service manager at my local VW van centre as my van was below the age and mileage limits. A week or so later I was sifting through all the paperwork for the Cali and saw a section saying extended warranty included until June 2024. My Cali is a 2019. I contacted the van centre and queried this and it was true, my Cali had the extended factory warranty for 5 years. They told me the system shouldn’t even have allowed the all in policy and was offered a full refund. After weighing up the pros and cons I left the policy running as the 2 services, mots, warranty (for 1 year with the all in policy) ) and the roadside assistance was worth the money I paid

I don't think it would - VW have offered you a full refund of the part of deal that you havn't used.
You have had the benefit of breakdown cover, A service & an MOT.

Due to the pricing structure of the all in scheme, its effectively pay for the service & MOT & breakdown cover & you get a free warranty.

If you hadn't been in eligible to join the All-In scheme due to the warranty still running, presumably you would still have had the service done, taken out breakdown cover of some sort & its usual to have the first MoT done at the dealers as the van would be under warranty to fix any faults. So where is your loss?

Hi Team, thanks for your replies. I’m not inclined to disagree with you. It just feels that VW are screwing me with a ‘take it or leave it!’ attitude. I do feel short changed but as some have said probably best to roll over and have my tummy tickled for a less stressful time of it. I might just stay with the current plan as overall that would be cheaper than taking the refund and then paying North of £1000 for a new plan. I just need to ’let it go’

There is normally a Black Friday Deal for the All in One Plan so it might be worth waiting until then. Also my dealer told me that there was a deal earlier this year I think in March so I took out the plan then. It only involved me waiting a weekend to get the deal but it was worth 20% off.
It might be worth having a chat with your dealer to see when the next offer is running.
You cannot have a Service Plan running alongside an All in One plan.

I can sort of see this. I expect the VW warranty is an insurance policy and so there would be a dispute between the two companies who was liable. At the time you are trying to get your Cali repaired. I would say if they are offering you a refund then that might be the cleanest way to go. That might then tie in with any Black Friday offer that VW might hold.
You could try the miss selling route but I expect that as they have offered you a refund then you may not be entitled to anymore.

Good news! After chasing VW through the Financial Ombudsman I have finally been compensated by VW. I probably should not go into too much detail here but suffice to say that as a result of a 'settlement deal' with VWFS I will be able to renew the policy next summer for another 2 years and still have plenty left over for a holiday too!

Result!
